Terms and Conditions
1. Change Orders Terms
All changes will be submitted as a new estimate and must be individually approved by you, our client, prior to any new work being initiated in addition to any other work already in progress.
Any items added from this project will be subject to a “change order” and an addition to the final price. Any change orders added after a project has already begun will be required to be paid in full at the time of the request for supplies and labor to be approved and scheduled
“The grand total pricing of this estimate is based on a “packaged deal” discount for this entire estimate if approved by you the client. This means If any line items, tasks, or portions of this estimate are requested to be removed after being approved, or once agreed work has already begun, the packaged deal discount will no longer apply and 15% of each approved line item removed will be due and billed based on its individual approved line item price, minus taxes.
These last minute changes are highly discouraged because they:
a. Impact our team’s reserved availability for your projects and limit our ability to insure expected work hours for our teams and does not provide sufficient time to schedule new customers who have been delayed to insure availability for you.
b. Incur administrative costs / office hours editing, adjusting, modifying an agreed estimate
c. Cause delays and or cancelation fees in equipment rented specifically to your project,
d. Incur restocking fees from supplies and or handling costs and fuel costs for returning materials purchased specifically for your project.
2. One Point of Authorized Contact
Only one designated authorized point of contact may make changes and approve estimates for your projects. Anyone that is not the sole owner of their home or property where the requested work is to be performed (such as a tenant), will be required to save a credit card on file with Elite Handyman & Remodeling which you authorize Elite Handyman & Remodeling in the event of non payment or past due balances. You understand and agree that you will be charged in accordance with the terms and conditions billing/payment schedule for cancellations, changes, non payment. All credit card payments are subject to incur credit card fees as well as indicated in section 9. of this document.
3. Written Agreements Only
There are no assumptions nor verbal agreements of work to be performed other than what is expressly written on and approved on the provided estimate/contract/proposal between you the client and Elite Handyman & Remodeling, our staff, field technicians, contractors, office staff, managers, or the owner. You as the client are responsible PRIOR to signing/approving any estimate/proposal/contract to ask any relevant questions if any portion, tasks, methods, or materials, supplies provided or excluded are not clearly understood.
4. Trash Agreement
Disposal or hauling away of debris produced by your project(s) is understood to not be included or the responsibility of Elite Handyman & Remodeling unless expressly stated or added as a line item in this estimate/contract/agreement/proposal. Debris haul off can be added to this agreement at an additional cost if requested or proposed by Elite Handyman & Remodeling which will be determined based on the project type. By approving this estimate you understand and agree you will make arrangements for where you would like Elite handyman & Remodeling to set debris/trash on your property or that you will handle it yourself once the project is completed or still ongoing if trash is restricting our staff’s progress.
5. Non in-person performed/provided Estimates
Bids/proposals/estimates provided by Elite Handyman & Remodeling without an in-person evaluation/consultation are subject to a change in final pricing in the situation where any customer provided descriptions, dimensions, and or photos were insufficient to translate the scope and breadth of a project, or if key details were omitted accidentally or purposefully. A revised estimate will be submitted for approval for the new scope of work and payment proportional to the amount of labor, and supplies incurred for any work already performed will be due. Cancelation terms and conditions as indicated in section 13. of this document may apply.
6. Water damage clause
Due to a number of unforeseeable unknowns which are common with water damage repairs or “rot”, Elite Handyman & Remodeling reserves the right to update the final amount due on any water damage repairs contract, with client awareness once a full damage assessment can be made after demolition begins. Repairs in this situation will not be made without client approval of new costs both for water damage or any further damage caused by demolition to expose the extent of initial water damage. An hourly rate may be proposed as a fair method of compensation for projects where water damage is present due to a number of unknowns typically associated with this type of project.
7. Paint Matching
No paint requested to be matched and supplied by Elite Handyman & Remodeling is guaranteed to match in color or sheen perfectly due to a number of circumstances and reasons, including: aging, fading, bad or dirty or stained sample used for the match, discrepancies in the formula used by the manufacturer, paint store associate’s personal opinion of a “good enough” match. If you the client (you or anyone else authorized to make decisions on your behalf) would like a second attempt at matching more perfectly, then the labor time to get a new match made and the areas/room repainted a second time will be charged as well as the cost of materials a second time. Paint matches are highly encouraged to be provided by our clients so there is no contention on potential matching issues.
8. Insurance work
Any estimates involving an insurance claim will have a 30% surcharge added to the total balance due because of:
a. Specific additional office hours in preparing your quote within their required format, software required to handle specific format for insurance work, office hours spent corresponding with adjusters and agents and our client.
9. Payment Agreement
By approving this estimate/proposal/contract you the client understand and legally agree to pay the total amount due upon completion of work as indicated by the “grand total” or the requested amount invoiced for work completed.
10. Payment Terms
A 50% deposit is required for all projects exceeding $500 before work begins and the final 50% due on completion.
For projects over $1,200, payments will follow a milestone payment schedule of: 50% deposit, 20% at 50% completion, 20% at 80% completion, and the final 10% upon completion. Completion will be based on discretion of our contractors, owners, and staff of Elite Handyman and Remodeling.
Final payment is due immediately upon project completion unless a prior agreement has already been approved. Late payments will incur a 5% fee of the remaining balance due every five business days the balance remains past due.
Cancellations made less than 48 hours before the scheduled start date will forfeit the deposit.
Clients choosing to pay via credit card are responsible for covering any associated processing fees. This fee will be at a 3.5% rate. These fees will be added to the final invoice.
Any unapproved delays in final payment will incur a 5% fee of the total balance due for every five business days the final payment is past due.
In summary, four payments on any project over $1,200 will be expected to bring the total amount paid of the agreed balance plus any additional change orders in sequence of: fifty percent deposit, seventy percent, ninety percent, and the final ten percent on completion of the project. Any work in progress will pause if payments are not made in this aforementioned payment schedule. Final payment arrangements are to be made with Elite Handyman & Remodeling immediately following the completion of the project.
11. Non Payment Penalties
Failure to make payment or to make a payment arrangement with ELITE handyman and remodeling after 7 days from the date an invoice is sent to you the client will result in a Mechanics Lien to begin to be put on your home or property and will not be removed until all balances due are settled and paid in full with Elite Handyman and Remodeling. This means your property will not be able to be sold until this debt is settled.
12. Hourly Work Terms
When agreeing to this proposal/estimate/contract at an hourly basis of labor as indicated by the line item title on your estimate, you the client acknowledge and understand you will be responsible to pay the final balance even if Elite Handyman Remodeling has overestimated or underestimated the time required and or the materials cost of the project required. You the client also understand and agree that a. no fixed amount is agreed, and b. actual costs will be calculated and invoiced based on actual labor time multiplied by the agreed rate and are not negotiable based on your assessment of speed, efficiency, or experience of staff or contractors, and c. final cost will include the costs of supplies, both purchased and provided from our inventory. Additionally by agreeing to this estimate/proposal/contract you agree and understand it is your responsibility to pay the determined total due of any work already performed by Elite Handyman & Remodeling even if the project is not completed.
13. Cancellation Terms and Fees
Once this estimate/proposal/contract has been approved by you the client, and a start date proposed has been agreed, you agree and understand that you will be legally responsible to pay a twenty five percent cancelation fee of the project total for any projects canceled by you the client within 48 hours of an agreed start date. Elite Handyman & Remodeling reserves the right to cancel this contract and the projects contained in this estimate/proposal/contract if discovered that inaccurate project descriptions or dimensions were given, or if details and information were withheld willfully or accidentally, once work has begun. You understand and agree that there will be a twenty five percent cancellation fee if false information given results in the termination of this contract. Disagreements, misunderstandings, or any willful obstruction of completion of the project by you the client/your family/your landlord/ETC… will have twenty four hours to be resolved with Elite Handyman & Remodeling or will be considered as a project cancelation and a final payment based on the percent of the work completed will be immediately due and/or Mechanics Lien procedures may begin to implement against your property. Weather related delays, or general rescheduling of the project will not be considered as a cancellation of this agreement by Elite Handyman & Remodeling. Elite Handyman & Remodeling will not be held liable for delays on beginning or during projects or failure to perform any scheduled projects due to circumstances beyond our control, including but not limited to natural disasters, severe weather, or unforeseen supply chain disruptions, staff being unavailable due to sickness, car accidents, ETC… nor will Elite Handyman & Remodeling be held liable for missed work days outside of our control, changes in project supplies and or labor costs due to delays outside of our control.
14. Devoted Work Agreement
By approving this estimate/proposal/contract you agree that ALL portions of work contained within this agreement shall be performed only by Elite Handyman & Remodeling unless otherwise indicated by you before in writing, or if declined by Elite Handyman & Remodeling and our staff. Verbal agreements will not be honored.
15. Estimate Price Guarantee
Pricing in this form is guaranteed for up to 30 days after which we reserve the right to adjust all pricing based on supply, demand, increased supplies costs and or labor costs.
16. Media Waiver
By signing this contract you agree to give permission for Elite Handyman & Remodeling to capture and distribute images and video of your project both before, in progress, and after project completion for our own company marketing purposes as well as for our portfolio of completed projects.
17. Advertising / Branding Agreement
Elite Handyman & Remodeling will place up to three yard signs with our logo in your yard during and until project completion for our marketing purposes. If you have an issue with this or if scheduled mowing is obstructed please let us know and we can remove the signs.
18. Availability Agreement
Any proposed availability is contingent on a strictly “first come, first serve” basis and will only be reserved for you when an estimate/contract has been formally “approved”.
19. Warranty Agreement
We guarantee our workmanship for 90 days from the completion date of the work. Any known issues must be brought to the attention of Elite Handyman & Remodeling within this 90 day period, (OR reasonably sooner if the issue can logically and reasonably be understood to increase the damages to your property), to be honored by this guarantee or this warranty will be rendered void and will not be honored due to client negligence. Our liability is limited to the cost of the services provided. We are not liable for indirect, incidental, or further consequential damages due to negligence on informing us or the appropriate parties i.e. a plumber to shut off water for example if a leak is known to be present.
All workmanship repair claims must be submitted in writing via email to info@elitehandymanremodeling.com within the 90 day period and must include photo or video documentation of the issue to be considered for a claim. All warranty claims will be evaluated and examined by Elite Handyman and & Remodeling and we reserve the right to use our expert discretion to determine whether the fault is genuinely our workmanship, or products / materials we provided. Elite Handyman and Remodeling will NOT warranty any work not performed by Elite Handyman & Remodeling and written in a line item title or description of tasks on our contract, nor any parts or materials which are defective purchased or provided by, you the client, even if these products and materials cause further damage to any surrounding structures. Any additional removal and reinstallation costs of these defective parts, repair of further damage due to defective parts, or delays of project completion costs will be at your cost and will not be honored as part of this warranty.
Any defective supplies, parts, and materials, which have been purchased and provided by Elite Handyman & Remodeling that have been determined to cause damage will be taken up first with the manufacturer for replacement, and a plan for repair or replacement of parts will be arranged to replace these defective parts.
20. Base Charge Agreement
Our service call MINIMUM / Base Charge for any visit is $365 daily for any work small or great whichever comes first, plus taxes. This base charge will be billed for any job if the line item falls below this minimum price threshold or if the scope of work is reduced by you the client or any authorized point of contact, bringing the total balance below this pricing threshold.
21. Client Safety and Waiver of Liability
Job sites can contain many unknown hazards to your safety and health. Elite Handyman and Remodeling will do our best to notify you of all potential risks on any active jobsite and help maintain a safe jobsite, however we cannot account for all things and your personal safety is your responsibility. Therefore all clients, their family members including children, pets, and or any guests on your property, MUST maintain a safe minimum distance of 25 feet from any exterior projects, 25 feet from any active work in a common area of your home with ongoing work both after hours and during business hours, and or refrain entirely from entering rooms where ongoing approved work is in progress on your property until the work is either completed or staff have notified you that all dangers are no longer a risk to your safety.
By approving this estimate, you understand and affirm that you will not hold Elite Handyman & Remodeling, our contractors, staff, owners, or investors, financially or legally responsible for any personal injuries that occur on the job site during the course of agreed work both after hours and during business hours. If you or anyone on your property chooses to enter the work area(s) on your property after hours or during business hours, you/they do so at your/their own risk and understand you/they have been notified of all potential risks.
22. Governing Law
These terms and conditions are governed by the laws of Texas, and any disputes will be resolved in the appropriate jurisdiction.
By engaging with our services at Elite Handyman & Remodeling, you acknowledge that you have read, understood, agreed to, and will abide by these terms and conditions. For questions or concerns, please contact us at Info@EliteHandymanRemodeling.com prior to approving any estimate or contract if these are not clearly understood or agreeable.
23. Right to Update Our T&C Agreement
Elite Handyman & Remodeling reserves the right to amend and or update these Terms and Conditions as necessary and will not be required to notify you of changes made when no ongoing work or scheduled work is being or will be performed between you and Elite Handyman and Remodeling. By selecting “Approve” you certify and agree that you have re-read, understood and re-agree to the version of the terms and conditions as written at the time and date of approval.
